Former Police Officer Sentenced for Phony Workers' Compensation Claim

On September 23, 2014, Ryan Patrick Natividad filed a workers’ compensation claim for an injured hand. A former Costa Mesa police officer, he stated that he had slammed his fist against a wall while trying to keep a suspect from running into it while being taken from a patrol car to jail. He filed a work-related injury claim for his hand later that day.
During an internal investigation, evidence was revealed that contradicted his testimony. It provided enough proof to doubt the validity of his account of how and when the injury occurred. During the trial, the district attorney showed a video that appeared to contradict Natividad’s statement. Natividad was convicted of making fraudulent statements and filing a false insurance claim to get money. He was facing up to 6 years in jail for the charges.
Attorney Ferrentino represented Natividad after his conviction, and filed a motion alleging ineffective legal assistance by his former counsel. Orange County Superior Court Judge Margaret Anderson refused the motion. Then, Ferrentino filed a recommendation to place Natividad on home confinement, which Judge Anderson accepted.
Ferrentino argued that there was no evidence to prove that Natividad committed insurance fraud. She worked hard and was able to limit his sentence to 6 months in jail on home confinement, which he will begin to serve in late September, 2017. With her help, Natividad will file an appeal.
